TERMS AND CONDITIONS OF SALE
1) General information
The purpose of these general conditions is to regulate the contractual relationship between the Customer and YAYATOOH hereinafter referred to as the "Company"
1.1. Definitions
'Customer' refers to any individual or company purchasing the Company's products.
'Consumer' refers to any Customer who is a private individual, acting for private purposes.
'Site' refers to the Company's website available at yayatooh.com
'GSC' means General Sales Conditions.
1.2. Applicability and modification of the general terms and conditions
These general terms and conditions take precedence over any other general terms and conditions, even if the latter specify the contrary. They are available and accessible at all times on the Company's website. They may be modified at any time by the Company, subject to prompt communication to the Customer. The new version of the general terms and conditions will only apply to contracts concluded after their entry into force.
The Customer is bound by these terms and conditions from the moment of payment for all products ordered online on the Company's website. The Customer is presumed to have read and understood them

Consequently, all orders validated by the customer in the yayatooh.com store imply unreserved acceptance of these terms and conditions.
Before payment, the customer will be able to view a clear and legible invoice showing all the prices associated with the purchase. Once payment has been received, the customer will promptly receive confirmation of the order by e-mail.
2.1. Product information
The products presented for sale on the yayatooh.com website are accompanied by one or more photographs. The photographs on the site are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly with regard to colors, which may vary depending on the Internet browser and screen used.
2.2. Product availability
The products presented by yayatooh.com are valid only while stocks last. YAYATOOH reserves the right to withdraw any product displayed on the site at any time and to replace it or modify any content or information appearing on the site. Despite its best efforts to satisfy its customers' expectations, YAYATOOH may be unable to process an order after having sent the customer the confirmation email summarizing the order. Should YAYATOOH be held responsible for this impossibility, it will reimburse the customer. In the event of unavailability of the product ordered, the customer will be informed as soon as possible and will have the possibility of requesting reimbursement or exchange of the product. Refunds will be made within a maximum of 30 days. YAYATOOH cannot be held liable to the customer for the replacement or modification of any site content after the order has been validated.
2.3. Prices
Product unit prices are displayed on the site and are available in CFA Francs, Canadian Dollars, US Dollars and Euros. YAYATOOH also takes all necessary steps to display the invoice clearly, visibly and legibly, including all charges (taxes, customs duties, brokerage fees, etc.) relating to the purchase before the latter is finalized and validated.
2.4. Discounts and rebates
Prices are fixed and are not subject to change at the Customer's request. Advantageous payment terms may be offered by the Company. The Company reserves the right to offer different payment terms depending on the time at which the Customer orders the Company's products, or depending on the payment schedule chosen by the Customer. These payment facilities are valid only at the time of their availability, and their granting in no way constitutes a right on the part of the Customer. They are, moreover, strictly linked to the offer concerned and are in no way general in nature.
3) Ordering
3.1. Ordering
The customer chooses a Product and places it in his/her shopping basket, which he/she may delete or modify before validating the order and accepting these GTC. They will then enter their contact details or log into their account and choose the delivery method. Once the information has been validated, the order will be considered definitive and will require payment by the Customer in accordance with the terms and conditions set out below.
A confirmation email summarizing the order (products, price, product availability, quantity, etc.) will be sent to the customer by YAYATOOH . To this end, the customer formally accepts the use of electronic mail to confirm the contents of his order.
YAYATOOH undertakes to inform the customer of any change in his order relating to the deadline in order to allow the latter to decide to modify his order accordingly.
YAYATOOH reserves the right to cancel any order from a user with whom a previous dispute exists.
3.2. Terms of payment
Payment of orders requires the creation or possession of a personal account on the YAYATOOH .site. Various payment platforms are available: the following are accepted:
YAYATOOH offers a variety of payment methods, including cheque, credit card, cash, direct debit, bank transfer, interbank transfer, electronic payment, ORANGE money, MTN mobile money and many others. Internet users can make their choice at their convenience.
The customer expressly acknowledges that the communication of his or her credit card number to YAYATOOH constitutes authorization to debit his or her account for the price of the products ordered. The company reserves the right to suspend any order in the event of refusal to authorize payment by financial institutions. In this eventuality, YAYATOOH will notify the customer of the cancellation of the order due to non-payment, to the e-mail address provided at the time of ordering.
The customer is advised that YAYATOOH cannot be held responsible for any embezzlement or fraudulent use of any means of payment not detected by the verification procedure.
Legal warranties of conformity
4.1 Legal warranty of ownership
YAYATOOH assures the buyer that que :

YAYATOOH makes every effort to supply and guarantee quality products. Nevertheless, YAYATOOH cannot be held responsible for any lack of conformity of a delivered product due to inappropriate use or storage after delivery, whatever the cause. 5.1 Proof of payment
The data recorded and kept by YAYATOOH under reasonable security conditions are considered as proof of communications, orders and payments between the parties.
5.2 Confidentiality
Confidential data relating to both the Customer and the Company, as well as to any third parties involved in the contractual relationship, collected in any way whatsoever and, essentially by e-mail exchanges, oral exchanges, as well as any future information, are intended solely for the performance of the Services and for communications between the parties. They will not be communicated or transferred to third parties not authorized by the parties.

YAYATOOH undertakes to use all necessary means to protect the customer's personal data. This data may be communicated to third parties for the exclusive purpose of providing a service. 5.4 Delivery times
YAYATOOH delivers internationally. The company does its utmost to dispatch orders as quickly as possible, and does so through third-party delivery specialists. Orders will be dispatched within 24 to 72 hours, depending on the destination, from the second following validation of the order by the customer (after confirmation of payment in the case of payment by bank transfer or cheque), unless otherwise indicated on the site.
In the event of delays in delivery, customers have 14 days in which to make a complaint and 7 days in which to request cancellation of the order.
Possible delivery locations are displayed on the site, and YAYATOOH works with delivery companies to ensure that the products ordered are dispatched.
The order number given after the order is placed makes it possible to track the progress and status of the delivery on the YAYATOOH website. Products are delivered to the address indicated by the customer on the order form. The customer is therefore responsible for verifying the accuracy and conformity of the information required for the delivery of his order, and in particular the mandatory e-mail address at which he can be contacted.
YAYATOOH cannot be held responsible for any information entry errors on the part of the customer and the consequences thereof, such as a delay and/or error in delivery. In this context, all costs incurred for the possible reshipment of the order will be charged to the customer.

In the event of an order cancellation, YAYATOOH is very open to an amicable agreement on the terms to be established to the satisfaction of both parties. The terms and conditions that may result from this agreement are by no means general and may be subject to change if necessary.

10) Withdrawal
For all orders sent from Europe, the consumer has a period of 14 working days from the date of receipt of the order to return any item that does not suit him/her and request an exchange or refund without penalty, with the exception of shipping and return costs which remain the responsibility of the customer. Returns must be notified in advance by e-mail to the following address: contact@yayatooh.com/info@yayatooh.com The product must be returned in its original condition and packaging, and must not have been used, worn, modified, washed or damaged, nor must it have undergone any deterioration, however slight. Otherwise, products will not be reimbursed, taken back or exchanged. The product must be returned within 14 days. After this period, the sale is firm and final.
For all orders that are not sent from Europe, the consumer can send an e-mail to contact@yayatooh.com/info@yayatooh.com to request a retraction.
Returns are at the customer's risk and expense, and YAYATOOH therefore strongly recommends that products be returned by recorded delivery, with a recommendation or additional insurance guaranteeing, where applicable, compensation for the actual market value of the products in the event of spoliation or loss of the merchandise.
Once the product has been returned, the company will check that it complies with the conditions and terms indicated above. If the checks are positive, YAYATOOH will send an e-mail to the customer confirming acceptance of the returned product.
In the event of exercising the right of withdrawal, the customer has the choice of requesting either a refund of the sums paid, or an exchange of the product. In this case, the product will be reshipped at the customer's expense.
In the case of a refund, YAYATOOH will reimburse the customer within a maximum of 30 days following receipt of the return. The refund will be made by the same means of payment used to purchase the product.
11) YAYATOOH Responsibility
11.1 General Responsibility
YAYATOOH cannot be held responsible :
- the quality of the Site, the Site being offered "as is";
- disruption of use of the Site;
- the impossibility of using the Site;
- breaches of computer security, which may cause damage to Internet users' computer equipment and data;
- infringement of the rights of Internet users in general.
11.2 Responsibility for information on the Site
YAYATOOH cannot be held responsible for any direct or indirect damage that may result from accessing or using the Site or the information contained therein, whatever its nature.
YAYATOOH makes every effort to provide up-to-date information on its Site. All information brought to the attention of persons accessing the Site has been selected at a given date.
The information appearing on the Site reflects an opinion at the time it was produced and not at the time the Site was consulted. For technical or other reasons, it may need updating at the time of consultation.
YAYATOOH shall not be liable for any errors or omissions. Any update, new service or new feature that enhances or augments one or more of the existing information contents shall be subject to these terms and conditions.
YAYATOOH declines all responsibility concerning the appropriateness of decisions and the terms and conditions of their execution made by Internet users solely on the basis of information published on the Site.
12) Arbitration clause
IN THE EVENT OF A DISPUTE ARISING FROM THE INTERPRETATION OR EXECUTION OF THESE TERMS AND CONDITIONS, THE COMPETENT COURT WILL BE DETERMINED IN ACCORDANCE WITH THE PROVISIONS OF COMMON LAW.
No class action is possible under any circumstances, and any Internet user contemplating a recourse will do so by way of arbitration only.
